THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 23858 of 2019 O R D E R:

Petitioner asserts that the information provided to him under the Right to Information Act on 20.08.2019 confirms that the audit report of respondent No.5-Society is not available in the Housing Section. In the circumstances, he seeks a writ of mandamus declaring the action of respondent No.2 in allowing respondent No.5 to function without renewal of Registration Certificate as mandated under Section 8-A of the Telangana State Cooperative Societies Act, 1964.

Considering the fact that writ of mandamus can only be issued when there is a demand seeking to perform the duty by the authority, and inasmuch as the petitioner has not approached the Registrar concerned for redressal of his grievance, the writ petition is disposed of giving liberty to the petitioner to approach the Registrar concerned setting out his grievance, which shall be considered by the Registrar, in accordance with law.
