THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8551 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused seeking bail in the event of his arrest in connection with Crime No.60 of 2023 on the file of Kotapally Police Station, Mancherial District, registered for the offences punishable under Sections 409, 420, 468 and 474 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The Branch Manager of Telangana Grameena Bank lodged a complaint before the SHO, Kotapally alleging that this petitioner is working in the said bank and had misappropriated an amount of Rs.27,94,190/-. He had fictitiously opened crop loan accounts and misappropriated the said loan amount. In the complaint, it is further stated that having detected the said acts of misappropriation committed by the petitioner, an amount of Rs.32,05,000/- with interest was recovered from the petitioner.

Admittedly, all the transactions took place in the bank and the documents are in possession of the bank. Even according to the complaint, the amount which was allegedly defrauded was recovered along with interest. Since the entire evidence is available with the bank and the amount is recovered along with interest, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner, subject to the following conditions:
1) The petitioner/Accused is directed to surrender before the Station House Officer, Kotapally Police Station, Mancherial District, on 15.09.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to his satisfaction. Further, the petitioner is directed to give samples of specimen, if required.
2) On such release, petitioner/Accused shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of eight weeks, for the purpose of investigation and thereafter, as and when required.
3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and
shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
