THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.39452 OF 2012 ORDER:
The memo under challenge in this Writ Petition was issued by the 4th respondent on 28.06.2012 informing Sri B. Srinivas, Dy.T.O (EM) to take complete charge of the post from several employees including the petitioner herein. The petitioner invoked the jurisdiction of this Court questioning the said memo, and sought a consequential direction to the respondents to allow him to discharge his duty as an Assistant Training Officer in the institute of the 4th respondent. The petitioner based his claim on G.O.Rt. No.1059 dated 03.09.2012 whereby the Government accorded permission to the Director of Employment and Training, A.P. Hyderabad to continue 781 Assistant Training Officers posts on contract basis for the academic session 2012-13, or till regular staff is allotted by the APPSC, whichever is earlier.
This Court, by its interim order dated 12.02.2013, directed the respondents to continue the petitioners in service until 31.03.2013. While the petitioner did not have the benefit of protection of the interim order from 01.04.2013 onwards, Sri B.S.S. Prasad, Learned Counsel for the petitioner, would submit that the petitioner has been continued in service from time to time. The petitioner's claim in this Writ Petition is based on G.O.Rt. No.1059 dated 03.09.2012 which merely required the respondents to continue him in service upto 31.03.2013, and not thereafter.
The cause in the Writ Petition does not, therefore, survive and the Writ Petition is, accordingly, dismissed as infructuous. Needless to
state that this order shall not preclude the respondents from continuing the petitioner in service, if they so choose. The miscellaneous petitions pending, if any, shall stand closed. No costs. ________________________________ RAMESH RANGANATHAN, ACJ Date: 16.12.2016 MRKR
