HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33734 of 2016 ORDER:

This writ petition is filed for a writ of mandamus against respondents 2 to 4 in not taking any action in spite of the complaint made by the petitioner on 24.08.2016 as illegal and arbitrary and consequently direct respondents 2 to 4 not to post the 5th respondent within the Guntur District. 2.

Heard and perused the material available on record. 3.

The grievance of the petitioner is that the 5th respondent, who is none other than his father-in-law, is compelling him, by taking advantage of his position as Sub-Inspector of Police, to execute Partition Deeds and also to alienate the property of the petitioner in his favour. The further apprehension of the petitioner is that if the 5th respondent is posted as Sub-Inspector of Police in Guntur District, there is every possibility of further harassment to the petitioner in the hands of the 5th respondent.

Even though the petitioner could not be able to substantiate the claim of harassment and other allegations, the Court is of the view that the writ petition can be disposed of with the following direction:

If the petitioner is aggrieved over the attitude and also the atrocious acts of the 5th respondent, he is at liberty to prefer a petition/complaint before the Inspector General of Police, Guntur Range (2nd respondent) seeking remedy.

On such petition/complaint, the 2nd respondent is directed to dispose of the petition/complaint in accordance with law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ____________________ RAJA ELANGO, J Date: 17th October, 2016 KL
