HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6945 of 2019 O R D E R :

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 is filed by the petitioner, who is A.1, for grant of anticipatory bail in the event of his arrest in Crime No.72 of 2019 of Garla Bayyaram Police Station, Mahabubabad, Warangal District, registered for the offences punishable under Sections 313, 376, 323, 294-B of IPC r/w. Section 109 of IPC and Section 4 of Dowry Prohibition Act. This is a case where the petitioner/A.1 loved the complainant in the name of marriage and got aborted her pregnancy and when she insisted for marriage, he abused her in filthy language, beat her and threatened her with dire consequences.

Heard learned counsel for the petitioner/A.1 and the learned Additional Public Prosecutor appearing for the respondent State. Perused the material on record. Learned counsel for the petitioner contends that the petitioner has not committed any offence much less the offence with which he is charged. It is also contended that the petitioner did not agree to marry the complainant by taking Rs.5.00 Crores and the parents of the complainant also did not agree to pay Rs.1.20 Crores towards dowry to the

petitioner and gave Rs.1.00 Lakh towards advance. It is also contended that the petitioner did not abuse the complainant in filthy language at any point of time nor demanded any money towards dowry from her. It is further contended that the bail application filed by the petitioner was dismissed vide order dt.24.09.2019 in Crl.M.P.No.929 of 2019 by the learned V Additional Sessions Judge, Kothagudem. It is contended that the petitioner is ready to abide by any conditions imposed by this Court, including assisting the investigating agency for his release on anticipatory bail in the event of his arrest in the above crime.

On the other hand, the learned Additional Public Prosecutor vehemently opposed the relief sought in the above petition.

As seen from the record, it is evident that there are specific allegations levelled against the petitioner that he demanded Rs.5.00 Crores towards dowry and the parents of the complainant paid Rs.1.00 lakh towards advance and thereafter some disputes arose between both the family members due to which the petitioner abused the complainant in filthy language. It is also evident that the petitioner had physical contacts with the complainant with a promise to marry her, due to which she became pregnant, however, the petitioner got her pregnancy aborted. His earlier anticipatory bail application was already dismissed by the Court below. In

view of the specific allegations levelled against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
