HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5536 OF 2017 ORDER:

This writ petition is filed for a mandamus declaring the action of respondents, in not releasing the petitioner's Car (Maruthi Suziki Swift) Registration No.TS04 EH0351, as being illegal and arbitrary.

The petitioner pleaded that he is the owner of the above-mentioned vehicle and that, on 06.01.2017, the said vehicle was seized by respondent No.3 alleging illegal transportation of black jaggery and alum. The petitioner submits that, despite his application dated 31.01.2017 to respondent No.2 for release of the vehicle, no order has been passed thereon.

Inasmuch as respondent No.2 is authorised to release the seized vehicle in terms of G.O.Ms.No.15, dated 19.02.2015, and as the petitioner's vehicle is evidently in the custody of respondent No.2, and the application dated 31.01.2017 has since been made to respondent No.2 for release of the seized vehicle, respondent No.2 shall consider and pass orders on the said application dated 31.01.2017 within three days from the date of receipt of a copy of this order and communicate the same to the petitioner. Subject to the above direction, the writ petition stands disposed of. No order as to costs.
