THE HON'BLE SRI JUSTICE L. NARASIMHA REDDY WRIT PETITION No.3140 of 2011 ORDER:
The petitioner's vehicle bearing Registration No. AP 21 Y 9204 was seized by the 3rd respondent on 15-11-2010, on the ground that he did not file proof of payment of tax and other reasons were also mentioned in the vehicle Check Report No.1689179. The seizure was effected as per the provisions of the Motor Vehicles Act. The grievance of the petitioner is that the respondents have not yet released the vehicle.
Heard the learned counsel for the petitioner and the learned Government Pleader for Transport.
As no purpose would be served by keeping the vehicle in the custody of the respondents and the vehicle would only get damaged, the writ petition is disposed of, directing the respondents to forthwith release the motor vehicle to the interim custody of the petitioner, subject to the petitioner paying the tax, and on filing an undertaking to the effect that he would produce the vehicle as and when the same is required by the respondents in the course of enquiry and investigation.
