HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.21935 OF 2007 O R D E R :

It is represented by Smt. Karuna Sree, Assistant Government Pleader that the subject-land in this writ petition, which is proposed for enhancing the limits of full tank level of Oora Cheruvu situated at Pagidimarri village of Utkur Mandal, Mahbubnagar district, is no longer sought to be required for acquisition purpose.

2. Basing on the counter-affidavit filed by the respondent Nos.1 to 3, it is represented that the petitioners and other land owners are cultivating the lands every year and the second respondent/District Collector came to a conclusion that there is no need to raise full tank level of Oracheruvu of Pagidimarri village. Accordingly, the lands belong to the petitioners and others to an extent of Acs:36-26 cents in survey No. 62 of Pagidimarri village of Utkoor Mandal, Mahbubnagar district, notified under section

4 [1] of the Land Acquisition Act are withdrawn under section 48 [1] of the Act, this writ petition needs no adjudication.

3. In view of the same, the writ petition is dismissed. No costs.

4. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stands closed.
