THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.57 of 2016 ORDER :

Heard counsel for the petitioner and the Government Pleader for Civil Supplies appearing for respondents.

2. Petitioner has assailed the order dt.29.12.2015 of the 3rd respondent suspending petitioner's Fair Price Dealership authorization.

3. It is not disputed that a show cause notice dt.17.12.2015 was issued to the petitioner by 3rd respondent, to which the petitioner had also submitted explanation on 28.12.2015.

4. Although the counsel for petitioner states that the petitioner has not committed any irregularities as alleged in the show cause notice or in the impugned order, this is a matter for enquiry by the 3rd respondent as contemplated in sub-clause (5) of Clause (5) of the A.P. State Public Distribution System (Control) Order, 2008.

5. Therefore, this Writ Petition is disposed of directing the 3rd respondent to complete the enquiry into the allegations against the petitioner on or before 30.03.2016 in compliance with principles of natural justice and the procedure prescribed in sub-clause (5) of Clause (5) of the A.P. State Public Distribution System (Control) Order, 2008 after giving a personal hearing to the petitioner. There shall be no order as to costs.

6. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
