HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition Nos.26778 of 2009 and 34639 of 2012 Common Order:
These two Writ Petitions are being disposed of by this common order as they were filed by the same petitioner challenging the action of the Commissioner, Parkal Nagara Panchayat, Warangal District for demolition of some structures belonging to the then Andhra Pradesh State Wakf Board.
In W.P.No.26778 of 2009 the Wakf Board is the first respondent and in W.P.No.34639 of 2012 it is the third respondent. The petitioner obviously is a third party and it is for the Wakf Board to protect the interest of its properties. This Court, by order dated 08.12.2009, directed that status quo shall be maintained in respect of the subject matter covered by W.P.No.26778 of 2009 and there is no interim order in the other Writ Petition. Obviously, the action is being taken by Nagara Panchayat for widening the roads and the owner of the property being the Wakf Board it would take appropriate action in accordance with law for protecting its properties. Now, it came to light that the counsel for the petitioner expired and none appeared for the petitioner. In the circumstances, in view of the nature of relief sought for in the present two writ petitions, these two Writ Petitions are disposed of granting liberty to the Wakf Board for taking appropriate steps for protection of its properties, if any, in accordance with law. There shall be no order as to costs.
ARLR, J WP Nos.26778 of 2009 and 34639 of 2012 As a sequel thereto, the miscellaneous petitions, if any, pending in these Writ Petitions shall stand closed.
