THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.20828 of 2018 ORDER:

Heard Mr.Pitta Srinivasa Reddy for petitioner and the learned Assistant Government Pleader for respondents.

The petitioner prays for the following relief: ".............Writ of Mandamus declaring the action of 4th respondent in mutating the unofficial respondents names in the revenue records and issued adangal copies with regard to the petitioner ancestral agricultural lands situated in Sy.No.171/1 to an extent of Ac.2.00 gts, Sy.No.176/1 to an extent of Ac.2.00 gts, Sy.No.172 to an extent of Ac.5.22 gts and Sy.No.175 to an extent of Ac.5.05 gts situated at Sompalli Revenue Village, Burgampad Mandal, Bhadradri Kothagudem District without having any reasons is illegal, arbitrary and against the principles of natural justice......." Counsel for the petitioner contends that the action of the 4th respondent in mutating the names of unofficial respondents in Adangal and 1-B register is arbitrary and illegal. Therefore, he prays for setting aside the entries mutated in the name of unofficial respondents and restore the name of the petitioner. The Assistant Government Pleader submits that petitioner can certainly file appeal before the Revenue

Divisional Officer/3rd respondent with all grievances. The Revenue Divisional Officer, in turn, will verify the records of subject matter of writ petition and passes orders as are deemed fit in the circumstances of the case.

Prima facie, this Court is of the view that the petitioner ought to have moved the 3rd respondent by way of appeal and thereafter, if any order is communicated in support of the changes already made, ought to have worked out legal remedies.

In the light of above consideration, I am satisfied the writ petition can be disposed of by this order: (a) the petitioner is given liberty to file appeal by enclosing a copy of this order before the 3rd respondent against the entries made in adangal as well as in 1-B register;

(b) the 3rd respondent considers and disposes of the appeal as expeditiously as possible.

Writ petition is accordingly disposed of. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
