The present writ petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to declare the action of the respondents 2 to 6, at the instance of respondents 7 to 13 trying to interfere with the lands of the petitioner to an extent of Ac.5.22 guntas of agricultural land in Survey No.34 situated at Renukapur Vilalge, Balapur Mandal, Ranga Reddy District, under the guise of interim order dated 01.10.2019 passed by this Court in Writ Petition No.22030 of 2019, as being illegal and arbitrary. Heard Sri D. Prakash Reddy, learned senior counsel appearing on behalf of Smt. K. Pallavi, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the official respondents 1 to 6 and Sri V. Ramakrishna Reddy, learned counsel appearing for the respondents 7 to 13. Two counter affidavits are filed in the matter i.e., one counter affidavit is filed by the 6th respondent and another counter affidavit is filed on behalf of respondents 7 to 13.
The learned Assistant Government Pleader for Home on the basis of counter filed by the 6th respondent submits that based on the complaints made by the petitioner against the respondents 7 to 10, two crimes were registered, viz., i) Crime
No.353 of 2019 for the offences punishable under Sections 447, 427, 341 and 506 read with Section 34 of the Indian Penal Code, 1860 IPC and ii) Crime No.389 of 2019 for the offences punishable under Sections 447, 427 and 506 read with section 34 IPC and took up investigation in the matter. The learned Assistant Government Pleader for Home further submits that the claim of the petitioner that the 6th respondent at the behest of respondents 7 to 13 under the guise of interim order dated 01.10.2019 in Writ Petition No.22030 of 2019, interfered with the agricultural lands of the petitioner to an extent of Ac.5.22 guntas in Survey No.34 situated at Renukapur Vilalge, Balapur Mandal, Ranga Reddy District is incorrect and baseless.
By the said counter affidavit, the 6th respondent has stated that except investigating into the two complaints made by the petitioner against the people named therein, the 6th respondent never interfered with the civil disputes as alleged by the petitioner nor interfered with the lands of the petitioner under the guise of interim order dated 01.10.2019 passed by this Court in Writ Petition No.22030 of 2019. Recording the said submissions made on behalf of the 6th respondent in the counter affidavit that except investigating into the complaints received, the authority is not interfering in civil disputes between the parties, no further orders are required to be passed in this writ petition.
Accordingly, the writ petition is closed. However, there shall be no order as to costs.
As a sequel thereto, Miscellaneous Applications, if any, pending in this Writ Petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 09.01.2020 Isn
