Counsel for the petitioners :: Learned Government Pleader for Services -II Counsel for the respondent :: Mr. Mohd Yousufuddin Interlocutory Application (SR) No.92365 of 2025 in Writ Petition No.19036 of 2006 This application is filed by the petitioners under Section 151 of Civil Procedure Code, 1908 praying the Court to restore the Writ Petition No.19036 of 2006 to file and recall the order dated 27.02.2025 in I.A.No.1 of 2023 in / and Writ Petition No.19036 of 2006 passed by a learned Division Bench of this Court.

Considering the objection that had been raised by the Registry where the objection was whether the second restoration petition filed by the petitioners would be maintainable in the factual backdrop where an earlier restoration petition had been rejected on merits, this Bench is of the considered opinion that the objection raised by the Registry is perfectly

justified. Therefore, the second restoration petitioner, after the first restoration having got dismissed on merits, would not be maintainable.

Accordingly, the instant application stands dismissed.
