HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.12055 & 4188 OF 2012 COMMON ORDER Since the subject matter of these writ petitions is one and same, both are heard together and disposed of by this common order. These writ petitions are filed for a writ of mandamus declaring the action of the respondent in issuing termination of contract order. Heard the learned counsel for the petitioner. Smt K.Manideepika, learned Standing counsel for respondent submits that there is a provision of arbitration clause in the agreement entered between the petitioner and respondent and in case of any dispute, they can avail the same.

No interim order is granted at the time of admission of these writ petitions.

Counter affidavit is filed on behalf of the respondent stating that since the petitioner failed to discharge the contractual obligations, the termination order was issued.

In view of the above facts and circumstances, I do not see any merit to entertain the writ petitions as there is arbitration clause in case of any dispute and this Court cannot into disputed questions of fact. Accordingly, the writ petition is dismissed. There shall be no order as to costs.
