THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1829 OF 2016 ORDER:

This petition is filed by the petitioner-accused seeking to quash the proceedings against him in F.I.R. No.138 of 2015 on the file of Chintalapudi Police Station, West Godavari District. Heard and perused the material available on record. It is alleged that while the husband of the de facto complainant was coming on his motor cycle to his village, Chintalapudi, along with a pillion rider, the petitioner came on his motor cycle in the opposite side in a rash and negligent manner and dashed against the husband of the de facto complainant, due to which he sustained grievous injuries and immediately, he was admitted in the government hospital and thereafter, he was shifted to Liberty Hospital at Vijayawada for better treatment. Subsequently, on 08.07.2015, the husband of the de fact complainant died. Hence, the de facto complainant lodged the present complaint against the petitioner.

Learned counsel for the petitioner submitted that the deceased drove his vehicle in an intoxicated condition and came in a wrong direction and hit the vehicle of the petitioner. Having regard to the facts and circumstances of the case and also the aforesaid submissions, this Court is of the view that this is not the stage to interfere with the investigation. However, if the respondent - police apprehend the petitioner, he can be released on bail on his execution of a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the like sum to the satisfaction of the arresting officer. The petitioner is directed to cooperate with the investigation. With the above observations, this criminal petition is disposed of. Miscellaneous petitions filed in this criminal petition,

if any, shall stand closed.
