HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No. 30637 of 2017 ORDER:

The writ petition is filed to declare the action of the 2nd respondent in continuing the petitioner under suspension basing on the proceedings No.E4/3102/GG&CH/2016-17/02/322, dated 14-03-2017 as illegal and arbitrary.

Learned counsel for the petitioner submits that the petitioner was placed under suspension by order dated 14-03-2017. But as on today no charge memo issued, as such, by relying on the judgment of Ajay Kumar Choudhary Vs. Union of India1 he submits that suspension cannot be continued beyond three months.

Learned Government Pleader Services produced the charge memo vide proceedings Rc.No.E4/3102/GG&CH/2017, dated 07-09-2017.

Since, the charge memo is already filed, it is for the respondents to review the suspension order and take decision. In view of the same, the writ petition is disposed of directing the respondents to review order of suspension dated 14-03-2017 and take decision in terms of G.O.Ms.No.86, dated 08-03-1994 within a period of four weeks from the date of receipt of a copy of this order and take action accordingly.
