THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 23886 of 2019 ORDER:

This Writ Petition is filed for the following relief: "....to issue a writ, order or direction, particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not releasing the vehicle bearing No.TS 19T 3413 of the petitioner which was seized on 25.09.2019 while plying on hire as illegal, arbitrary and violation of principles of natural justice and consequently direct the 2nd respondent to release the vehicle bearing No.TS 19T 3413 of the petitioner. "

When the matter is taken up, it is submitted by the learned counsel for the petitioner as well as learned Government Pleader for Prohibition and Excise appearing for respondent Nos.1 and 2 that the issue raised in the present Writ Petition is squarely covered by the order 28.01.2019 passed by this Court in W.P.No.1392 of 2019. Relevant portion of the aforesaid order reads as under: "As the vehicle of the petitioner was seized by respondent No.3 on the ground of violation of the excise laws, the petitioner is at liberty to submit an application before the Jurisdictional Deputy Commissioner under Section 34 of the Telangana Excise Act seeking release of the subject vehicle. Thereupon, the said authority shall consider and pass appropriate orders on such application within a period of one week from the date of receipt thereof. Subject to the above, the writ petition is disposed of."

In those circumstances, following the above said order and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof.

Miscellaneous Petitions, if any pending, shall stand disposed of. There shall be no order as to costs.
