Heard the counsel for petitioners, and the learned Government Pleader for Revenue, for respondent.

The petitioners have filed this Contempt Case contending that there is a willful disobedience of the order dt.13.04.2016 in WP.No.10235 of 2016.

The learned Government Pleader for Revenue, appearing for respondent, has placed before me an endorsement dt.04.07.2016 of the respondent considering the petitioners' application for issuance of pattadar passbook and title deed, and rejecting the same giving certain reasons.

Though the counsel for petitioners sought to contend that the rejection of petitioners' request by the respondent is not valid in law, I am not inclined to go into the said issue in the present Contempt Case since the petitioners can as well challenge the said endorsement dt.04.07.2016 by way of a fresh Writ Petition also. Even if there is some delay in implementing the order, I am of the opinion that the delay is not such as to be construed as willful. Therefore, I am of the view that the respondent cannot be punished for contempt of court. Therefore, the Contempt Case is closed. No order as to costs.
