HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10599 OF 2017 ORDER:

The case of the petitioner is that she made an application on 27.11.2015 to the 5th respondent for mutation of her name in the revenue records pertaining to the land admeasuring Ac.500 cents i.e., Ac.1.78 cents in Sy.No.32/3C3, Ac.2-00 cents in Sy.No.32/3C6 and Ac.1-00 cents in Sy.No.32/3C7, Ac.0-22 cents in Sy.No.34/3 of Peda Korada Village, Raiwada Post, Devarapalli Mandal, Visakhapatnam District having purchased the same through registered sale deed dated 01.03.2006. But the 5th respondent rejected the application of the petitioner without issuing notice and without passing any speaking order. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Though the matter was adjourned for the sake of getting instructions, the learned Assistant Government Pleader could not produce the speaking order.

In view of the above facts and circumstances, without going into the merits of the case, only on the ground of violation of principles of natural justice, the impugned order is set aside and the 5th respondent is directed to consider the application of the petitioner and pass a speaking order, after issuing notice to the petitioner.

With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 04.04.2017 dv
