THE HON'BLE SRI JUSTICE R. SUBHASH REDDY CIVIL REVISION PETITION No.1118 OF 2010 ORDER:

This Civil Revision Petition, under Section 115 of the Code of Civil Procedure, 1908 (for short, 'C.P.C.'), is filed by the judgment debtor aggrieved by the order, dated 19.02.2010, passed in E.P.No.20 of 2008 in O.S.No.552 of 2005 by the learned Principal Junior Civil Judge, Tiruvuru, by which, the petition filed by the respondent - decree holder, under Order XXI Rules 37 and 38 C.P.C., was allowed with a direction to detain the petitioner in civil prison.

This Court, by order, dated 19.03.2010, passed an interim order, which was extended from time to time, and on 12.09.2014, the interim order was extended on condition of petitioner depositing 50% of the E.P. amount within two weeks from the date of that order. However, when the matter was listed on 10.10.2014, as there was no representation on behalf of the petitioner, this Court has directed that if the conditional order, dated 12.09.2014, is not complied with, interim order passed on 19.03.2010 shall stand vacated. Even today, when the matter is called, there is no representation on behalf of the petitioner. It appears that the petitioner is not interested in

pursuing the revision petition.

Accordingly, the Civil Revision Petition is dismissed for non-prosecution. Miscellaneous Petitions, if any, pending in this revision petition shall stand closed. No costs. ______________________ R.SUBHASH REDDY, J 27th January, 2015 MD
