Petitioner was working as Librarian Grade-II in Hyderabad City Grandhalaya Samstha. In transfer counselling taken up by the Director of Public Libraries, petitioner is now shifted to Branch Library, Thandur Zilla Grandhalaya Samshta, Vikarabad. 2.
According to learned counsel for petitioner, petitioner is due for retirement on 31.08.2019, and his transfer just before his retirement would cause lot of hardship and suffering. Transfer guidelines are formulated by the Government pursuant to lifting ban on transfers. According to the transfer guidelines, no person shall be retained beyond five years of service in a particular station as on 31.05.2018. However, an exemption is granted to an employee retiring before 31.05.2019 from such compulsory transfer. Whereas petitioner is actually retiring in August, 2019 and, therefore, petitioner is not falling into exempted category. Thus, no direction as sought for can be granted. Writ petition is dismissed, granting liberty to petitioner to make a representation to the Director of Public Libraries for consideration of retention or to post at appropriate place nearer to city pending retirement. As and when such representation is made, it is open to the Director to consider and to pass appropriate orders.
Pending miscellaneous petitions shall stand closed. There shall be no order as to costs.
