In all these writ petitions, the impugned order is passed on similar lines regarding the applications of the petitioners for grant of mutation and for grant of pattadar passbooks in respect of subject lands in the writ petitions. Learned counsel for the petitioners submits that the impugned order is passed without notice to the petitioners and also without giving details of the cases pending and no proper reasons are assigned.

Learned Assistant Government Pleader for Revenue on instructions submits that there are civil cases pending in respect of subject lands in various Courts and Golden Forests India Private Limited is under liquidation.

As per proviso to Section 5 of A.P.Rights in Land and Pattadar Passbooks Act before any application for mutation is rejected, the respondent-authorities are obligated to issue notice to the petitioners. Though the impugned order shows that the case is pending in the Supreme Court with regard to subject land, but no details are given and the same is passed without giving any reasons.

Without expressing any opinion on merits, the impugned order is set aside and the 2nd respondent is directed to pass orders on the applications of the petitioners,

after issuing notice to the petitioners by giving speaking order as to the details of cases pending in various Courts, within a period of eight weeks from the date of receipt of a copy of this order.

With the above direction, these writ petitions are disposed of. As a sequel to the disposal of these petitions, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 03-04-2017 Nvl
