The present writ petition is filed questioning the Memo, dated 26-08-2015 passed by the 3rd respondent.

Learned counsel for the petitioner has produced a copy of the explanation filed by the petitioner on 21-05-2015, wherein the petitioner has accepted that in Sy.No.393 he would demolish the water plant building and shift the water plant to the adjacent area of his company and accordingly requested time. The impugned Memo is issued based upon the said undertaking given by the petitioner. In any case, the petitioner has already preferred an appeal before the 2nd respondent along with the stay application. Hence, there are no reasons to entertain the writ petition. Accordingly, the writ petition is dismissed. However, the 2nd respondent shall consider the stay application filed along with the appeal and pass appropriate orders in accordance with law. No costs.
