THE HON'BLE SRI JUSTICE S.V. BHATT C.C.No.2004 OF 2015 ORDER:

The contempt case is filed complaining disobedience of interim order dated 30.03.2015 in W.P.M.P.No.11383 of 2015 in W.P.No.8627 of 2015.

On 07.11.2015, notice to respondent was ordered and on 11.02.2015, the contempt case was admitted.

The respondent is present in Court and has filed affidavit explaining the happenings in the matter. Prima facie, I am satisfied that the respondent after coming to know the order passed by this Court on 30.03.2015, being the DHr in E.P.No.156 of 2014 in Arb.No.261 of 2013 on the file of Principal Senior Civil Judge, Kothagudem, has not pressed the EP. The respondent has filed application seeking vacation of the order dated 30.03.2015 in W.P.M.P.No.11383 of 2015. For two reasons viz., that E.P.No.156 of 2014 is not pressed by the respondent and also that a petition to vacate the interim order is filed and pending, I am satisfied that the disobedience alleged against the interim order is not made out. The contempt case fails and is, accordingly, dismissed. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, also stand disposed of.
