The writ petition is filed questioning the inaction of respondents 3 and 4 in registering FIR on the basis of the complaint dated 15.04.2019 submitted by the petitioner.

Heard learned counsel for the petitioner, learned Government Pleader for Home and Sri Raghavender Reddy, learned counsel appearing for respondents 10 and 11.

As seen from the writ affidavit averments, it is evident that the dispute raised is in relation to the excess amount being charged for purchase of cinema tickets for which payment is stated to have been made through Paytm.

Learned Government Pleader, on written instructions dated 04.11.2019, would submit that based on the complaint of the petitioner dated 15.04.2019, an enquiry was conducted and on such enquiry, it is revealed that no case of cheating is made out. In the instructions, it is further stated that a notice was communicated to the petitioner through registered post on 01.06.2019, informing him that the matter complained of, prima facie, does not fall under cheating and directed the petitioner to approach the Consumer Forum for redressal of his grievance, as the police have no jurisdiction to interfere in such matters, since it is the dispute between the consumer and the trader.

If the petitioner is aggrieved by the said communication, it is open for him to avail appropriate remedies in accordance with law.

In the light of the aforestated written instructions, the writ petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
