THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10199 of 2010 ORDER:
This Writ Petition was filed challenging the action of respondent Nos.4 and 5 in harassing the petitioner and his family members by calling them to the Police Station and insisting them to surrender in C.C.No.96 of 2008 on the file of the learned Judicial First Class Magistrate, Kurnool, pursuant to the charge sheet filed in Crime No.96 of 2007.
Learned Government Pleader, on the basis of the written
instructions, submits that pursuant to the complaint filed by one Golla Venkatadri on 22.07.2007 a case in Crime No.96 of 2007 was registered on the same day against accused Nos.1 to 27 and during the course of investigation the prima facie case was established only against accused Nos.1 to 23. The petitioner was shown as accused No.24. The name of the petitioner was mentioned as Kolai Sunkanna alias Chinna Ranganna as accused No.24 by mistake since a large number of accused were cited by the complainant. The investigation revealed that the petitioner did not participate in the crime and hence proposals were sent to the Sub Divisional Police Officer, Kurnool, to delete the name of the petitioner as accused No.24 along with other accused Nos.12, 22 and 23.
The Sub Divisional Police Officer, Kurnool, did not accord permission due to mistake. C.C.No.96 of 2008 pending before the learned Additional Judicial First Class Magistrate, Kurnool, was transferred to the learned Judicial First Class Magistrate, Prohibition and Excise, Kurnool and renumbered as C.C.No.455 of 2008 and it is pending trial. The respondents filed a petition before the said Court on 14.06.2010 seeking permission of the Court to take back the NBW issued against the petitioner as accused No.24 and after obtaining permission from the Court, the name of the petitioner as accused No.24 will be deleted from the charge sheet. This was the position as on 18.06.2010.
In view of the categorical statement made by the respondents in their written instructions issued to the learned Government Pleader, nothing survives for adjudication in this Writ Petition. The Writ Petition is, accordingly, closed. The miscellaneous petitions pending, if any, shall also stand closed.
