This petition is filed under Section 24 of C.P.C seeking to withdraw O.P.No.1118 of 2017 pending on the file of the Family Court, Vijayawada and transfer the same to the Court of the Senior Civil Judge, Repalle, Guntur District.

2 Heard the learned counsel for both parties and perused the record.

At the time of arguments, both counsel submitted that the petitioner filed O.P.No.38 of 2018 against the respondent on the file of the Senior Civil Judge, Repalle for restitution of conjugal rights and the respondent filed O.P.No.1118 of 2017 on the file of the Family Court, Vijayawada against the petitioner for dissolution of marriage. They further submitted that the petitioner and respondent are practising doctors. Both counsel submitted that both the O.Ps may be transferred to the Court of Principal Senior Civil Judge, Machilipatnam in order to avoid inconvenience to both parties. In view of the submissions made by the learned counsel for both parties, this Court is of the considered view that it is a fit case to allow the petition.

In the result, the petition is allowed, O.P.No.1118 of 2017 pending on the file of the Family Court, Vijayawada is withdrawn from the file of the said court and transferred to the Court of the Principal Senior Civil Judge, Machiliapatnam for disposal in accordance with law and O.P.No.38 of 2018 pending on the file of the Court of the Senior Civil Judge, Repalle is withdrawn from the file of the said court and transferred to the Court of the Principal Senior Civil Judge,

Machiliapatnam for disposal in accordance with law. As a sequel, miscellaneous petitions, if any pending in this petition shall stand closed.
