HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.4286 of 2016 ORDER:

Vide the present petition, the petitioner seeks a direction thereby directing the respondents to issue new passport with correct date of birth and name as '28.04.1991' and 'Hussain Ahmed' respectively considering the terms of circular dated 18.04.2001.

Learned counsel appearing on behalf of the petitioner submits that, similar issue came up for consideration earlier in various writ petitions, and, more particularly, in W.P.Nos.19376 of 2007 and 21156 of 2010, wherein this Court directed the respondents to correct the date of birth as per the material produced by the applicant.

The petitioner herein filed various certificates which establishes his date of birth as '28.04.1991'. It appears that the entry relating to the date of birth of the petitioner in his passport was by inadvertence. Such corrections being insignificant and inconsequential, they are required to be carried out upon being satisfied about the genuineness of the claim in that regard. Accordingly, I hereby direct the respondents to consider the application of the petitioner dated 22.12.2015, for correction of date of birth and his name in the passport, within four weeks from the date of receipt of a copy of the order.

The Writ Petition is, accordingly, disposed of.

Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs. SURESH KUMAR KAIT, J
