THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.31446 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondents in not taking action on the complaint, dated 24.08.2016, made by the petitioner against the 4th respondent, as illegal and arbitrary and consequently to direct the respondents to register a crime and complete the investigation. Heard and perused the material available on record. The case of the petitioner is that the petitioner has transferred Ac. 1.20 guntas of land to the 4th respondent on 30.05.2016 and that the 4th respondent has issued cheque bearing No.20301 for Rs.15,00,000/-, which is ante-dated. The petitioner requested the 4th respondent to change the date on the cheque many times or to issue fresh cheque or else cash, but the 4th respondent has not done the same. Aggrieved by the said acts of the 4th respondent, the petitioner has made report before the 3rd respondent on 03.08.2016 and also on 10.08.2016, but till now the 3rd respondent has not registered the case against the 4th respondent.

Considering the grievance of the petitioner, the 3rd respondent is directed to register a case against the 4th respondent, if the complaint lodged by the petitioner, 03.08.2016 and 10.08.2016, discloses any cognizable offence and investigate into the same and file a final report, if any. If the petitioner is aggrieved by the action of the 3rd respondent, he is at liberty to approach the superior officer of 3rd respondent and also to

approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 1st November, 2016 KL
