SMT. JUSTICE T. RAJANI CRIMINAL PETITION No. 17364 OF 2016 O R D E R :
This Criminal Petition is filed under Section 482 of Cr.P.C., seeking to suspend the order in C.C.No. 156 of 2011, dated 06/ 09/ 2016 by virtue of which the Judicial Magistrate of First Class, Vyalpad, Chittoor district, issued Non-bailable warrants against the petitioners.
2. Heard the learned counsel for the petitioners and the learned counsel for the respondent No.1 as well as the learned Public Prosecutor appearing for the respondent No.2/ State.
3. The counsel for the petitioners submits that the stay granted by this Court by virtue of its order dated 03-01-2012, in spite of the stay being in operation the lower court issued Non-bailable warrant which cannot be sustained.
3. A perusal of the docket shows that stay was granted by this Court on 03/ 01/ 2012, hence the issuance of Non-bailable warrant would amount to violation of the stay order. Hence, considering the above, this Criminal Petition is allowed and the order of the court below is set aside, recalling the Non-bailable warrants issued against the petitioners/ A-1 and A-2.
4. In the result, this Criminal Petition is allowed.
5. As a sequel, miscellaneous petitions if any, pending in this criminal petitions stand disposed of.
