HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
According to the petitioner, land to an extent of Ac.4.30 cents in Sy.No.5 part of Kurrakaluva Village, Chandragiri Taluq, Chittoor District, originally belongs to his grandfather. The name of his grandfather was mutated in the revenue records and petitioner succeeded to the said property. While so, in the year 2013, it was noticed that in the revenue records, the status of the land was changed from the private patta to that of cattle grazing land in the adangals for the Faslis 1421 and 1422. Having noticed the same, petitioner and his sister applied to the Tahsildar requesting to rectify the same in the revenue records. 2.
As Tahsildar did not consider their request, revision was preferred under Section 9 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (Act, 1971). The said revision was heard and reserved for orders on 29.10.2016. Alleging inaction in passing orders in the revision, this writ petition is filed. 3.
Learned Government Pleader submits that the incumbent Joint Collector was changed and, therefore, the revision could not have been decided earlier and fresh hearing is required. Learned counsel for petitioner or learned Government unable to say whether any orders are passed by the Joint Collector in the revision and when the incumbent Joint Collector was changed. 4.
Having regard to these facts and as both counsel agree for disposal of the writ petition, writ petition is disposed of, without expressing any opinion on merits. The Joint Collector is directed to
consider the revision, if no orders are passed, after affording due opportunity to both sides and pass appropriate orders as warranted by law. It appears as the revision petition is pending for a long time, the Joint Collector is directed to expedite hearing and finalize the proceedings as expeditiously as possible, at any rate within a period of two months from the date of receipt of copy of this order.
