THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.8578 and 8579 of 2023 COMMON ORDER:

These Criminal Petitions are filed under Section 438 of Cr.P.C. by the petitioners/accused Nos.2 and 4 seeking bail in the event of their arrest in connection with Crime No.63 of 2023 on the file of Talamadugu Police Station, Adilabad District, registered for the offences punishable under Sections 294-B, 448, 427 and 307 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case of the de facto complainant is that the petitioners, along with others, have trespassed into his house and questioned the victim regarding illegal intimacy with one Oruganti Swathi of the village and nearly 14 persons have allegedly attacked the victim. 4.

Learned Public Prosecutor, on instructions, would submit that the injured were already treated and discharged from the hospital. 5.

As seen from the remand report of accused Nos.1, 3, 5, 6 and 7, they have confessed about the presence of the petitioners at the scene of offence. During the investigation there are neither specific overt acts attributed to these petitioners nor any descriptive particulars in the complaint.

In the said circumstances, this Court deems it appropriate to grant relief of anticipatory bail to the petitioners subject to the following conditions:

1) The petitioners/accused Nos.2 and 4 are directed to surrender before the Station House Officer, Talamadugu Police Station, Adilabad District on 20.09.2023. On such surrender, the said Station House Officer shall release the petitioners/accused Nos.2 and 4 on bail, on their executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/accused Nos.2 and 4 shall appear before the concerned Station House Officer every Monday and Wednesday for a period of eight weeks at 10.00 AM or until the charge sheet is filed, whichever is earlier.

3) The petitioners/accused Nos.2 and 4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, these criminal petitions are allowed. Miscellaneous applications, if any pending in these criminal petitions, shall stand closed.
