HON'BLE SRI JUSTICE S.V.BHATT W.P. No.34777 OF 2016 ORDER:

Heard Mr.Pavan for petitioner and the Assistant Government Pleader (Land Acquisition).

The petitioner prays for the following relief: "...writ of mandamus declaring the action of the 3rd respondent in trying to release the compensation amount in favour of respondents 5 & 6 in respect of the lands in Sy.No.13 to an extent of Ac.12-00 gts; Sy.No.14 to an extent of Ac.1-20 gts; Sy.No.86 to an extent of Ac.2-08 gts;

Sy.No.100/1 to an extent of Ac.5-11 gts;

Sy.No.79/AA to an extent of Ac.6-06 gts; Sy.No.41 & 47 to an extent of Ac.2-00 gts; Sy.No.104 an extent of Ac.5gts respectively situated at Ibrahimpeta and Ganapavaram Village, Kukunoor Mandal of West Godavari Dist., without considering my objection dt:19-82016 as illegal, arbitrary, and violative of principles of natural justice and consequently direct the 3rd respondent to refer the matter to a competent civil court under Sec.76 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013..."

The Assistant Government Pleader places on record written instructions dated 15.10.2016. The operative portion of the instructions reads thus:

"As regards, the contention of the petitioner that the respondent No.3 is going to disburse the compensation amount for the lands for acquisition and to stop payment and referring the matter to the Civil court u/s 76 of under Act 30 of 2013, it is submitted that at present the LA cases pertaining to Ibrahimpeta and Ganapavaram villages are in Declaration Stage and only after completion of Award enquiry and passing of award the

compensation amount will be disbursed to the rightful owners."

Having regard to the statement of respondent No.3, counsel for the petitioner requests the Court to dispose of the writ petition by placing the reply of respondent No.3 on record. The statement is placed on record and the writ petition is disposed of accordingly. No order as to costs.
