THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN WRIT APPEAL No.1125 OF 2016 JUDGMENT: (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) The appellant/writ petitioner was operating Mid Day Meal facility. That was suspended on 28.08.2014 by the second respondent, Tahsildar, who is also the Chairman of the Mandal Level Implementation Committee of the Mid Day Meal programme. Following that suspension order, it appears that no further enquiry was then held. The petitioner, therefore, moved this Court by instituting W.P.No.5792 of 2015, from which this Writ Appeal arises.

By the time the aforesaid writ petition came up for hearing, this Court had already decided W.P.No.9800 of 2013 on 30.12.2014, issuing directions on such matters. The learned single Judge followed that judgment and has ordered the Writ Petition from which this Writ Appeal arises, to be covered in terms of the directions contained in the order issued in W.P.No.9800 of 2013.

Mid Day Meal Scheme is intended for a very specific purpose to support the school children. It is an implementation scheme for the objects sought to be achieved in terms of the Directive Principles of State Policy in consonance with Article 21 and other Articles of the Constitution, which relate to the affairs

of children including those in the economically weaker sections of the society.

We are of the view that, over and above the directions given by the learned single Judge, there is no room for any further indulgence by this Court; at any rate, at this distant point of time. We, therefore, refuse to entertain this Writ Appeal. 5.

The Writ Appeal is accordingly dismissed.
