HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6969 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the order dated 18.10.2019 passed in Crl.M.P.No.1977 of 2019 in crime No.178 of 2019 by the XIV Additional Chief Metropolitan Magistrate-cum-XV Additional Chief Metropolitan Magistrate(FAC), Hyderabad. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent and perused the material on record.

Learned counsel for the petitioner submits that the Court below has imposed onerous condition of depositing of Rs.4,00,000/- towards security and re-depositing of passport on or before 12.01.2020, which is very difficult for the petitioner to deposit such huge amount as he is working as driver in UAE with meager salary and the Court below ought not to have imposed such onerous condition in view of the nature of offence. It is also submitted that the petitioner is law abiding citizen and ready to face the trial before the trial Court and sought to set aside the impugned order by allowing the criminal petition.

Learned Assistant Public Prosecutor supported the impugned order and sought for dismissal of the petition by confirming the impugned order.

On perusal of the material on record, this Court does not find any error in the impugned order and it requires no interference.

Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
