HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23921 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ......to issue a writ, order or direction, particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not disposing the appeal dated 27/ 12/ 2017 filed by the petitioner, wherein praying to withdraw the proposal reducing two annual increments of the petitioner and also to declare the action of the 2nd respondent in issuing the Office order vide Ref.No.RG2/ PER/ CF/ SR/ 3169, dated 8.12.2017 as illegal and arbitrary and violative of principles of natural justice and consequently set aside the Office Order vide Ref.No. RG2/ PER/ CF/ SR/ 3169, dated 8/ 12/ 2017 issued by the 2nd respondent ....." .

Heard Mr.Y.Nagaiah, learned counsel for the petitioner and the learned Standing Counsel for the respondents. It has been contended by the petitioner that he is working as an Assistant Chainman with the respondents and while discharging duties, the 2nd respondent imposed punishment of reduction of pay by two annual grade increments with cumulative effect against him vide order dated 08.12.2017. Aggrieved thereby, the petitioner has preferred an appeal to the 1st respondent on 27.12.2017. But, so far, the 1st respondent has not disposed of the said appeal. Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the 1st respondent to

consider and dispose of the appeal preferred by the petitioner on 27.12.2017.

Learned Standing Counsel appearing for the respondents has contended that the 1st respondent would consider and dispose of the appeal preferred by the petitioner on 27.12.2017 in accordance with law within a reasonable period of time.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the 1st respondent to consider and dispose of the appeal preferred by the petitioner on 27.12.2017, in accordance with law, if not already disposed of, within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
