THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN WRIT PETITION NO.36410 OF 2013 ORDER:

This Writ Petition is filed challenging the action of the second respondent, in not producing the petitioner's vehicle Bolero Maxi Truck bearing temporary registration No.KA-34-TR-3406 before the Judicial Magistrate of First Class, Rayadurg, Anantapur District, as illegal and arbitrary.

Learned Government Pleader for Home, on instructions, would submit that the subject vehicle was produced before the Court along with Form No.66 on 21.12.2013 and the Judicial Magistrate of First Class, Rayadurg, directed the third respondent to retain custody of the vehicle and produce it at the time of trial.

The petitioner's request for release of the subject vehicle, and to be granted interim custody thereof, should be addressed to the learned Judicial Magistrate of First Class, Rayadurg, before whom the vehicle has already been produced.

Leaving it open to the petitioner to approach the learned Magistrate, the Writ Petition is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ (RAMESH RANGANATHAN, J) 27th December 2013 Note: Issue CC by three days B/O RRB
