THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.39580 OF 2012 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue a Writ, order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents 1 to 3 herein in not initiating any action against the 4th Respondent herein in pursuance to the Petitioner's representation dated 1-9-2012 as highly illegal, arbitrary and unconstitutional and consequently seeking directions against the Respondents 1, 2 and 3 herein to forthwith examine Petitioners representation dated 1-9-2012 and take appropriate action against the 4th Respondent herein, to impose appropriate punishment under the Rules and to release reasonable compensation to the Petitioner herein in the interest of justice."
2. A Counter affidavit is filed by the Sub-Inspector of Police, District Special Branch, Karimnagar and paragraph No.12 of the said counter affidavit reads as under:
"12. It is humbly submitted that all the averments made in the affidavit filed in support of the writ petition are the subject matter of enquiry into the representation of the petitioner herein dated 01.09.2012 for which a detailed enquiry was conducted by the Sub Divisional Police Officer and submitted the enquiry report to the Superintendent of Police, Karimnagar District and basing on the enquiry, the then Superintendent of Police, Karimnagar District awarded punishment of "Censure"."
3. In view of the averments made at Paragraph No.12 of the counter affidavit filed by the Sub-Inspector of Police, District Special Branch, Karimnagar, this Court deems it appropriate to dispose of the writ petition by recording the said averments.
4. In view of the above, the Writ Petition is disposed of, by recording the above averments made at Paragraph No.12 of the counter affidavit filed by the Sub-Inspector of Police, District Special Branch, Karimnagar.
5. Miscellaneous Petitions, if any, pending shall stand closed. No costs.
