HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos. 5661, 5663 & 5693 OF 2017 COMMON ORDER:

Since the subject matter of all these writ petitions is one and the same, all the writ petitions are heard together and disposed of by this common order.

These writ petitions are filed challenging the impugned proceedings No.B/5202/2015, dated 10.02.2017, wherein the petitioners were asked to submit objections regarding closure of bore wells. In the penultimate paragraph of the said notice itself, the petitioners were ordered to close down the borewells within seven days. Aggrieved by the same, the petitioners filed these writ petitions.

Learned counsel for the petitioners submits that in the impugned notice itself the respondents asked the petitioners to submit objections and also to close down the bore well without waiting for objections, which is in violation of principles of natural justice.

A perusal of the impugned proceedings goes to show that though it is in the form of show cause notice, there is a direction to the petitioners to close down the bore wells within seven days. In view of the same, it is open for the petitioners

to file explanations to the impugned proceedings dated 10.02.2017 within four weeks from today. On such explanations being filed by the petitioners, the 3rd respondent shall pass orders, in accordance with law, after giving opportunity of hearing to the petitioners. Till such time there shall be stay of seizure of the petitioners' bore well. Accordingly, these writ petitions are disposed of. No order as to costs.
