THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39852 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent in registering the FIR No.191 of 2014 against the petitioners under Sections 498-A, 406 IPC and Sections 4 & 6 of the Dowry Prohibition Act, as illegal and arbitrary. The case of the petitioners is that the 3rd respondent lodged the present complaint alleging that the 1st petitioner is her husband and 2nd and 3rd petitioners are his sister and brother-in-law and she further alleged that the 1st petitioner along with his family members harassed the 3rd respondent physically and mentally for additional dowry. The main grievance of the petitioners is that the 3rd respondent has foisted a false case against the petitioners with an intention to harass the petitioners.

Learned counsel for the petitioners submitted that the 3rd respondent filed a divorce petition in O.P.No.1005 of 2014 and also a maintenance case in M.C.No.191 of 2014 before the Additional Family Court Judge at Hyderabad.

Considering the grievance of the petitioners and the submissions of the learned counsel for the petitioners, the 2nd respondent is directed to complete the investigation in FIR No.191 of 2014 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 18th November, 2016 KL
