This Criminal Petition is filed under Section 437 & 439 of the Code of Criminal Procedure,' 1973 (for short "Cr.P.C.") seeking regular bail to the petitioners/A1 & A2 in Crime No.26 of 2022 on the file of Bollarum Police Station, Begumpet, Hyderabad, registered for the offences punishable under Sections 20 (b) (ii) (c) and 27 of NDPS Act, 1985.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.
The case of the prosecution is that on 29.03.2022, Bollarum Police have found several persons including the petitioners and found that Accused No.1 had brought four small tins of Hash oil and, at the spot, delivered to Accused No.2. The police caught hold of Accused Nos.1 and 2 and other members, who were also present there, absconded from the spot. The police identified the petitioners as peddlers and the others, who fled from the scene, as drug consumers. 4.
As seen from the remand report, it is evident that it was Accused No.1 who had brought the tins of Hash oil and, at the spot, delivered to Accused No.2. Meanwhile, the other persons, who were also present there, absconded.

In the circumstances, the specific case of the police is that it was Accused No.1 who has brought Hash oil to the spot and delivered to others. Thus, this Court deems it appropriate to grant bail to petitioner No.2/Accused No.2 subject to the following conditions. i. Petitioner No.2/Accused No.2 is directed to be released on bail on executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of XXII Additional Chief Metropolitan Magistrate at Secunderabad.
ii. On such release, petitioner No.2/Accused No.2 shall appear before the concerned Station House Officer on every Monday between 10.30 a.m. and 01.00 p.m. for a period of eight weeks, for the purpose of investigation. iii. Petitioner No.2/Accused No.2 shall abide by the other conditions stipulated in Section 437 (3) of Cr.P.C. 6.
As far as petitioner No.1/Accused No.1 is concerned, the Criminal Petition is dismissed.

Accordingly, the Criminal Petition is partly allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
