THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO TRANSFER CIVIL MISCELLANEOUS PETITION No.663 OF 2017 ORDER:

The transfer petition is filed by the petitioner/ respondent/ wife under Section 24 C.P.C., to transfer F.C.O.P.No.49 of 2017 on the file of the Judge, Family Court, Guntur, to the Judge, Family Court, Vijayawada.

Heard both sides.

As per the settled expressions, the convenience of the wife is more for consideration is that of the husband in matrimonial matters, from the inconvenience expressed, apart from the fact that there is a maintenance suit even for a child, represented by mother pending on the file of the Family Court, Vijayawada, this Court, to sub-serve the ends of justice permits transfer of F.C.O.P.No.49 of 2017 on the file of the Judge, Family Court, Guntur, to the Judge, Family Court, Vijayawada and the Judge, Family Court, Vijayawada, may dispense with the personal appearance of the respondent/ husband, when representing through advocate unless his appearance is required as and when specifically directed.

Accordingly, the Tr.C.M.P. is allowed.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. There shall be no order as to costs.
