Smt. M. Nagendra v. The State Of Telangana Rep. By Principal Secretary,
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.33855 of 2015 ORDER:
Heard.
The petitioner complains of illegal interference and attempt to dispossess by the 3rd respondent and his subordinates in respect of the lands admeasuring Ac.122 gts., in Sy.No.57/2 and Ac.0-34 gts., in Sy.No.57/3 situated at Regulachelaka Village, Khammam Urban Mandal, Khammam District. The petitioner states that she was given provisional patta on 25-01-2015 and thereafter, pattadar pass books and title deeds were also issued vide Patta No.167. She claims that she belongs to S.C. Community and she is in possession and enjoyment of the said lands. While so, the 3rd respondent and his subordinates are visiting the lands in question and trying to dispossess her without issuing any notice and without there being any reason.
Heard the learned Government Pleader for Revenue. Since the petitioner has filed copy of pattadar pass books and title deeds and well as patta stated to have been issued in her favour, I deem it appropriate to direct the 3rd respondent not to dispossess the petitioner and interfere with her possession over the aforesaid lands, except after giving written notice to the petitioner and opportunity to submit explanation, if her possession is objectionable on any ground. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
