THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.9734 of 2025 ORAL ORDER:
This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.3 in Crime No.295 of 2025 dated 27.06.2025 before Kothapalli Police Station, Karimnagar District, registered for the offences punishable under Sections 127(2), 137(2), 115(2) read with 3(5) of BNS.

The case of the prosecution is that the de facto complainant lodged a complaint stating that he was introduced to Madhavi with whom he has done real estate business due to which they used to meet each other at Karimnagar. It was alleged that since few days quarrel raised between them regarding the real estate business due to which on 26.06.2025 Madhavi called him through WhatsApp informing him that she came to Karimnagar town, then they left in his Scorpio bearing No.TS23G4545 and later both of them went to his guest house at Chinthakunta Village, where they quarreled regarding business, which followed arrival of
ten associates of Madhavi who beat him with hands. On receipt of the said complaint, a case was registered against the accused persons, including petitioner, who was implicated as accused No.3. Aggrieved thereby, this Criminal Petition is filed.

Heard Sri P.Ramesh Babu, learned counsel for petitioner, and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor, appearing for respondent - State. 4.
Learned counsel for petitioner submitted that the allegations leveled against the petitioner are nothing but abuse of process of law. He contended that petitioner is no way concerned with the alleged offence and is implicated falsely in the case only on the ground that he is younger brother of accused No.1. He averred that only basing on the confessional statement of accused No.1, the petitioner was implicated in the case. He asserted that accused Nos.1 and 2 were arrested and are already released on bail. While advocating that the material part of the investigation is concluded, he prayed this Court to allow the Criminal Petition, granting the relief of anticipatory bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor, vehemently, opposed the submissions made by learned counsel for petitioner, and submitted that the allegations leveled against the petitioner are of serious to which his custodial interrogation is necessary. As such, he prayed the Court to dismiss the criminal petition. 6.
Having regard to the rival submissions made, on going through the material placed on record, it is noted that the averments of the complaint does not disclose any allegation against the petitioner with regard to extortion of money from de facto complainant, and except the said offence, all the other offences as alleged are punishable for less than three years. Considering the circumstances of the case, and the fact that the material part of the investigation is completed, this Court deems it fit to grant pre-arrest bail to the petitioner subject to compliance of the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Kothapalli Police Station, Karimnagar District, within two weeks from today, and on such surrender, the said Station
House Officer shall release him on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
