HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.24101 of 2017 ORDER:

Heard learned counsel for petitioner and learned Government Pleader for respondents.

The petitioner states that he is the absolute owner and possessor of land of an extent of Acs.0.17 guntas in Survey No.4/1 situated at Garimella Village, Mancherial Mandal and District, having purchased the same under registered sale deed dated 13.06.1997. While so, the respondents 2 and 3 issued a preliminary notification dated 04.01.2017 by publishing in newspapers on 08.01.2017 proposing to acquire the land of an extent of Acs.0.271⁄4 guntas in survey No.4/1 of Garimella Village, Mancherial Mandal and District. In respect of the said lands, the names of the pattadars are mentioned as under.

Adimulam Sattaiah, S/o Rajaiah.

Adimulam Thirupathi, S/o Rajaiah Kandi Bhumakka, W/o Narsaiah Adimulam Srinivas, S/o Venkati Yangandula Shankaramma, W/o Mallaiah Adimulam Ramesh, S/o Muttaiah The name of the petitioner was not mentioned as pattadar. Since the total extent of land is of an extent of Acs.2.18 guntas, it is not known whether the land purchased by the petitioner is also proposed for acquisition or not. Now the learned Government Pleader submits that no award has been passed and the award enquiry is yet to commence. In view of the same, liberty is given to the petitioner to appear before the third respondent if the part or entire land of the petitioner is involved in the acquisition and the third respondent shall consider the claim of the petitioner and pass appropriate award in accordance with law. In order to enable the petitioner to appear for award enquiry, the third respondent shall issue notice to the petitioner.

The writ petition is accordingly disposed of.
