HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.8593 of 2014 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue an appropriate writ, order or direction, more particularly one in the nature of writ of mandamus declaring the action of the 4th respondent in unlawfully taking petitioner's relative viz., Arvapally Ramesh, s/o. Subbaiah, aged 55 years, R/o. Kodad, Nalgonda District, into custody without there being any complaint or case registered him and without issuing the arrest card, as being illegal, arbitrary and unconstitutional and consequently direct the respondent No.2 and 3 herein to take action against the 4th respondent herein." Learned Government Pleader appearing for the respondents placed on record written instructions dated 21.11.2019 issued by the SubInspector of Police, Yellandu Police Station, Bhadradri Kothagudem District.

From a perusal of the said written instructions, it is revealed that the present Sub-Inspector of Police, Yellandu Police Station assumed charge on 18.11.2019 and as per the available station records and the general diary dated 18.03.2014, the then Inspector of Police i.e., the 4th respondent neither taken custody of the said Arvapally Ramesh nor arrested him on 18.03.2014 as alleged by the petitioner. In fact, the copies of the general diary extracts are enclosed with the written instructions. It is further stated in the written instructions that the present writ petition is filed on mere apprehension and the 4th respondent discharged his legitimate duties.

In these circumstances, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed. Accordingly, the writ petition is dismissed.
