HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32215 of 2017 ORDER:

1) Heard learned counsel for the petitioners and Government Pleader for Land Acquisition.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the impugned preliminary notice No.B/ 787/ 2017, dated 24.07.2017 issued by the fifth respondent, as illegal, arbitrary and repugnant to the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

3) Though various grounds are raised, learned counsel for the petitioners would submit that pursuant to the notice issued on 24.07.2017, the petitioners have submitted their explanation. Without passing any orders to the explanation submitted by the petitioners, the respondent officials are trying to lay a pipe line through the land of the petitioners, which is illegal and improper. 4) The Government Pleader for Land Acquisition, on instructions submits that notice was issued on 24.07.2017 and thereafter the authorities have contemplated to proceed with the work.

5) It is to be noted here that a show cause notice was given on 24.07.2017, calling for objections within a period of thirty days from the date of publication of the notice. Pursuant to the said

notice, the petitioners have submitted their explanation within the time prescribed, but without passing any orders, the authorities are trying to interfere with the possession of the petitioners, by laying a pipe line.

6) Having regard to the above, the respondents-authorities are directed to pass orders on the explanation submitted by the petitioners, as early as possible, preferably, within a period of two weeks from today. Till such time, status quo as on today shall be maintained.

7) With the above direction, the Writ Petition is disposed of. 8) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
