HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.23973 of 2019 ORDER:

The grievance of the petitioner is that respondent No.5 is interfering with his possession and enjoyment in respect of house site admeasuring 288 sq. yards in Sy.No.1, situated at Laxmidevipally Village, Palvoncha Mandal, Bhadradri Kothagudem District, while C.M.A.No.31 of 2018 is pending on the file of respondent No.2 - Project Officer-cum-Additional Agent to Government, Bhadrachalam, Bhadradri Kothagudem District. Learned counsel for the petitioner submits that inasmuch as C.M.A.No.31 of 2018 is pending before respondent No.2, the said Authority may be directed to dispose of the same within a time frame, since taking advantage of the pendency of C.M.A.No.31 of 2018, unofficial respondent No.5 is interfering with the possession and enjoyment of the petitioner over the said land.

Having regard to the facts and circumstances of the case, this Court is of the view that C.M.A.No.31 of 2018 preferred by unofficial respondent No.5 be considered and disposed of by respondent No.2 as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. Further, in the event of the petitioner's possession over the subject land is under challenge by unofficial respondent No.5, the petitioner is at liberty to approach respondent No.4 or any other appropriate higher authority seeking interim relief in relation to the protection of his possession over the subject land.

TVK,J W.P.No.23973 of 2019 With the above observations and direction, this writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
