ORAL ORDER:

Petitioner alleges that the Roads and Buildings Department is undertaking the construction of drainage and in the process, private property of the petitioner is affected and due process is not followed so far. Learned Assistant Government Pleader, on instructions, submits that so far no steps are taken to construct the drainage and as and when drainage construction is taken up and if private property is likely to be affected for such construction, respondents shall follow due process as required by law before taking possession of such private property.

In view of the categorical statement of the second respondent to the learned Assistant Government Pleader, apprehension expressed by the petitioner no more survives. It is needless to observe that respondents shall follow due process before acquiring private property for public purpose, including construction of drainage.
