HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8285 OF 2017 ORDER:

This writ petition is filed questioning the proceedings dated 28.10.2016, issued by the 1st respondent in R.O.C.No.382/2000-A-1, directing the petitioner to vacate the Shop No.3, Sri Yerramilli Narayana Murthy Municipal Shopping Complex, Main Road, Narasapuram, West Godavari District. Considering the fact that the above said shop (building) is in dilapidated condition and the same is required to be demolished, the respondent authorities had issued a notice under Section 231 of the A.P. Municipalities Act, 1965, to the owner as well as to the tenant, directing them to vacate the same.

The facts do not justify any interference by this Court. Even otherwise, the learned counsel for the petitioner filed an undertaking affidavit before this Court to vacate the above said shop premises on or before 30.06.2017 and the same is taken on record. It is also stated in the undertaking affidavit that the petitioner would clear all the pending dues before he vacates the premises and hand over the same to the respondent authorities. Subject to the above undertaking given by the petitioner, the writ petition is closed by making it clear that if any violations of undertaking affidavit would result in contempt proceedings against the petitioner. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous.
